Re: Who can prosecute Gurus?

This is one of those "it depends" matters. Context and content count. For example, providing forms of the typical "fill in the blank" variety is not the practice of law-- otherwise, lots of printing companies would be under "cease and desist" orders. "LegalZoom&quo...

Re: Real estate development, sovereign style

And the Texas right of redemption can be a "hollow" right: See, e.g.: Sec. 34.21. RIGHT OF REDEMPTION. (a) The owner of real property sold at a tax sale to a purchaser other than a taxing unit that was used as the residence homestead of the owner or that was land designated for agricultura...

Also, there is usually a redemption period -- pay the taxes, penalties, interest, fees, get the property back. I took a glance and it would appear Montana has a 2 year redemption period.

Re: KPMG Credible Tax Scam?

The "Son of Boss" tax construct destroyed the fine old Dallas firm of Jenkins and Gilchrist. J&G had picked up a Chicago lawyer with his own version, which he promoted heavily through J&G (to the HUGE profits of all of the partners, of course). When "whatever" hit the fan...

Re: What to do if you know people who may get duped

Replying to comments from the fringe about fractional reserve banking and "money on/of account" and creation of money is a waste of time. To quote the science fiction writer, Robert Heinlein, from the novel Time Enough for Love : " Never try to teach a pig to sing; it wastes your time...

Re: Dead giveaways of foreclosure charlatans

Having written extensively on the issues related to the mortgage foreclosure crisis, I would note that even experienced lawyers have had little success in challenging the "mess" created by sloppy securitization of mortgage obligations. Most courts seem to think that UCC -mandated procedure...

Re: Anyone know about the law of status?

This is/was the ruling of the N.C. court in Cruden's Ex'rs v. Neale, 2 N.C. 338 (1796) (the West Law S.E. Rptr. cite is incorrect). The initial material incorporated by the reporter is, as Famspear points out, a recitation of the arguments made by counsel for the parties. The opinion: Per curiam We ...

Re: "Corporate" US

I was thinking about this, and I can't help but wonder if it's also partially a misreading of private corporations vs. municipal corporations; i.e. an intentional confusion of the term "corporation". But they don't seem to get all bent out of shape at local or state incorporation, so I'm ...

If PD wants an answer, he should ask GOOGLE, which would direct him to a number of sites that describe mortgages and deeds of trust. See, e.g ., http://www.nolo.com/legal-encyclopedia/whats-the-difference-between-mortgage-deed-trust.html Mortgages and deeds of trust are just devices to create a vali...

Although I rarely weigh in, and visit infrequently (press of business, so to speak), perhaps the best "evidence" that jurisdiction is irrelevant to the concept of consent is found in the circuit-level cases interpreting Stern v.Marshall , ___ U.S. ____, 131 S. Ct. 2594 (2011). Stern , as s...
