Re: "practical lawful dissent" fmotl advisory group

District Judge would indicate England. I guess he will have been convicted in his absence, these offences seem to only result in fines (I guess they could charge careless or dangerous driving for blatant infringements). So next stage I guess will be notification of the fine, then enforcement procedu...

Re: Robert 'Crab Bait' White consents to losing his houses

Robert White shared a link to the group: Practical Lawful Dissent. 10 Lis Pendens delivered to the banks involved and land registry, and all recorded in the common law court. Looking forward to the next step. Don’t forget everyone can record their own documents with the common law court at no cost....

Re: Robert 'Crab Bait' White consents to losing his houses

I can't imagine that except in the most obscure and complicated situation, this would be applicable given the laws of bankruptcy. If you had an interest in one of White's properties, you talk to the receiver - end of. Yes I was thinking that this morning, the trustee probably doesn't even have to g...

Re: Robert 'Crab Bait' White consents to losing his houses

Unfortunately it will not. Lis pendens is not legitimately applicable in England and Wales, and in any event has to be filed in the county land records office, not an imaginary rebel "court" with no jurisdiction beyond it's website. The lender banks will not intervene to support Krabby, b...

Adrian James The remedy though, surely Julian Daniels, is to refute and demand proof of DRIVING. Blacks law dictionary, which I'm assured is the dictionary used by UK courts states quite clearly that the definition of DRIVER is one employed to conduct a wagon.... What are the odds that he's not eve...

Re: Rekha Patel loses her house

It's quite normal for estate agents to show photos with the current (or previous) owner's furniture in place. Irrespective of practicality in normal sales, houses generally look better furnished. I wouldn't take it to imply that the furnishings are included, or even that the house is currently furni...

He’ll be very, very lucky if he’s only charged with driving without a licence. Nor having the legally required insurance is often treated very seriously indeed these days. A £300 fine and six endorsement points if the police issue a warning, an unlimited fine and driving ban if it goes to court. An...

Re: Robert 'Crab Bait' White consents to losing his houses

Depends on how bothered the OR is, but theoretically the income from the rentals isn't Krabby's . A tenant who still chose to give cash to Krabby after being informed of the situation would not be paying their rent, and they could be evicted. OR could then sell the house or put new tenants in, payi...

The terminology all implies decrim, ie the term PCN and no mention of conviction etc. However I can't see it stated either way. Does the PCN have the option of court, like a road traffic fixed penalty?

Re: Robert 'Crab Bait' White consents to losing his houses

There have also been some relatively recent changes in tax breaks for buy to let landlords. 12/18 months ago - I can't remember. It was stamp duty wasn't it? BTL no longer get tiered rates owner occupiers get. Extra 3% stamp duty on second or subsequent properties. The other change was how interest...

Re: "practical lawful dissent" fmotl advisory group

On a related subject the post below shows Crabbie having a rant about someone declining his advice regarding a Dartford Crossing penalty (that will be a decriminalised council matter I think?) Just Googled it and it isn't. It is a fine and I think you will get a PCN for not paying. Yep £108 if you ...

Re: "practical lawful dissent" fmotl advisory group

Doesn't voluntary manslaughter require either Loss of Control, or Diminished Responsibility to distinguish it from murder? I don't see how either can apply to a corporate body. At least under (some states in the) US law, a corporation can commit manslaughter. If the action results in injury rather ...

Re: "practical lawful dissent" fmotl advisory group

Something about "attempted manslaughter" which seems a irrational concept. I disagree. Attempting an act, so reckless, that if it had resulted in death, might be "attempted manslaughter". Alternatively, according to Quora, killing someone in the heat of emotion would be voluntar...

Yep, egged on by the others even though there's been an unbroken history of failure with road traffic offences. Re: Robert 'Crab Bait' White consents to losing his houses

A couple of possibilities occur to me. Maybe his property empire is failing with arrears on his loans etc etc. That might explain the self destructive path he's taking now, a combination of anger that his goldmine is no longer delivering and maybe a belief that he has nothing left to lose. That migh...

Full Disclosure. This is another term trotted out as if they thought it had some sort of magical meaning. Typically it just gets thrown to their rants and ramblings without clarification .. full disclosure of what? Another term blindly borrowed from US legal conventions?

In Scotland it does after a fashion, but it is mostly ceremonial as in High Sheriff of somewhere. Up here a Sheriff is a judge, something akin to an English District Judge or higher .. The main role of sheriffs is to sit as a trial judge, though they do have some appellate functions. The criminal j...
