The tax protester in this situation typically has a false belief that if the case were to be dismissed for lack of jurisdiction , the tax liability would somehow go away. On February 13, 2015, the Texas Medical Board entered a final order denying Clayton's application to have his license reinstated.

On March 31, the Board denied his motion for a rehearing.
