Sandia Park Fugitive Arrested for Failure to Appear on Tax
Evasion Charges
Santa Fe – Karl Erich Mehner, of Sandia Park, was arrested on a Bench Warrant
issued by First Judicial District Court Judge Stephen Pfeffer. Judge Pfeffer issued
the Bench Warrant on December 1, 2006 after Mehner failed to appear at his
arraignment on four felony counts of attempts to evade tax. Mehner, a fugitive
since December 2006, was arrested by officers of the U.S. Marshals service and
the Santa Fe County Sheriff’s Department. TRD Secretary Rick Homans
commented on the arrest: “New Mexico relies on voluntary tax compliance from
all our hard working citizens. Make no mistake—if you attempt to evade paying
your taxes, we will find you and prosecute you.”
Mehner was indicted by a Santa Fe County grand jury on November 2, 2006 for
willfully attempting to evade his New Mexico Personal Income Tax or the payment
thereof for the tax years 2000, 2001, 2002, and 2003.
Mehner pleaded not guilty at the arraignment, and is currently being held at the
Santa Fe County Detention Center on a $200,000 cash only bond awaiting trial. A
trial date has not been set.
If convicted, Mehner faces imprisonment of one year and a fine of $1,000 to
$10,000 on each count.
The case was a result of an investigation by the New Mexico Taxation and
Revenue Department’s Tax Fraud Investigations Division. The Division is
currently conducting over 50 investigations throughout the State of New Mexico in
a number of industries and occupations.

Posted on a Redemption Yahoo group on Sunday,
Please add Karl Mehner to your prayer chain. He has a hearing tomorrow
morning at 8:15 a.m. mst. He has been held for 10 months in detention on
alleged state tax evasion charges without a trial. He is doing what
Greg has been suggesting to get in honor and close the case. We both
could use all the prayers we can get. Thank you all very much.

This afternoon's update:
9 Feb 09

There were seven witnesses present at the hearing, the subject of which
was jury selection.

Judge Pfeffer announced that Earl Rhoads was appearing as "stand by" for
the Defendant. One of the attorneys (I couldn't tell which one) said
that the jury selection should be towards the end in case "something
untoward should happen." Dow said that Mr. Mehner thinks the state owes
him a lot of money and was going to put his name on a 1099. Karl said
that "Mr. Mehner" was an ens legis fiction and that the court should
address him as Karl Erich.

Judge Pfeffer said that, if Mr. Mehner gets all the money he's trying to
collect, he'll make Forbes Magazine and that "there is no escrow account."

Karl said he's willing to plead guilty to the facts in exchange for his
release and having the case closed and settled. The judge asked a
question unrelated to Karl's statement. Karl asked if he was refusing
to close and settle the case. The judge again ignored Karl's question
and asked his own question re: jury selection, and Karl repeated _his_
question.

Judge Pfeffer told Karl to be prepared to make an opening statement at
the jury selection and that Karl's jury selection would be done at the
end. He also said that Rhoads would be available in case Karl has any
questions.

(Before Karl's case was called, there was an inmate who had fired his
attorney, and some of us were wondering if Karl had been coaching him.)

Is this the magical escrow account opened in the strawman's name at birth which can be used to pay debts? I bet they're saying that there is no escrow account because it's filled with tan M&Ms and OK soda. And Zima.

Then it would be a case of the blind leading the blind. Of course there is the chance that when this stunt backfires and the inmate discovers that Karl had given him bum advice, he might decide to pay Karl a visit in his cell and demand a "refund."
