Judge Says Unusual Beliefs Don't Reflect On Competency

CONCORD, N.H. -- A federal judge has ruled that Elaine Brown is competent to stand trial on weapons and conspiracy charges.
In denying a defense motion to conduct a competency evaluation, U.S. District Judge George Singal ruled Tuesday that there was no basis for believing that Brown is not competent to stand trial.
Brown and her husband, Ed Brown, were convicted in 2007 for failure to pay income taxes. Before their arrest and conviction, the Browns kept federal officers at bay from their Plainfield, N.H., home for nearly a year.
The conspiracy and weapons charges are connected to that standoff.
Ed and Elaine Brown have maintained that they don't believe they are required to pay federal taxes. They have also maintained that the courts don't have jurisdiction over them, and they didn't plan to participate much in their trials. But they both also said they would represent themselves.
In his ruling, Singal wrote that Elaine Brown's beliefs don't mean that she's not competent to stand trial.
"The mere fact that this Defendant's view of the applicable laws diverge from the views of the Court is not a basis for questioning a defendant's competency or finding a defendant incompetent," Singal wrote.
Singal wrote that Elaine Brown understands the jury and trial system and is capable of conducting and assisting in her defense. He said that a full competency evaluation would needlessly delay the trial.

The first time I ever saw something like this (and it was only slightly less ridiculous) was in a mortgage elimination package a lady in Phoenix was trying to use to obtain her condo in Flagstaff "free and clear." Of course the $495 package "guaranteed" results because the bank could not answer the "affidavit of truth," and she was shocked, shocked I tell you that not only was she being foreclosed on, she couldn't find an attorney to take her case even though she had the money, to wit:
"... we have saved over nine-thousand in the program but all the attornies [sic] in Flagstaff are afraid of the banks and won't take our case. Our tenant is threatening to move out. Can you recommend someone?"
She didn't like being told she had been scammed.

Maybe the court could cut down on the crap being filed by E&E by restricting (or eliminating) their Internet access, and limiting their "research" to actual statutes and court opinions.
