The sentencing hearing was today. Any word?

Checking the docket, Jackson has filed a number of motions lately, based on the PRA and Fifth Amendment, etc. Interesting order @ 83.

Why has there been no media report on the sentencing hearing?

Inquiring minds [me] want to know what happened in the court room. I'm sure a transcript will be released at some point, but it's interesting there's been no major or local media reporting.

Rumor has it she aggressively argued the Paperwork Reduction Act.

I've been following the case but don't have a copy of docket 72. It would appear to be part of her idiot motions filed prior to alleging the PRA. She appears to have had a change in her approach.

Reading her most recent motions, she still makes the argument, "NOT Defendant, pro per, etc." Docket 72 sounds an awful lot like that. I'd like to see a copy too.

I doubt any media attended the trial and the DOJ press room hasn't issued a release yet. Some districts are slower than others.

However, I wondered if it had to do with the fact she argued the PRA, and since there's such a division among the courts on that particular issue, whether there was some difficulty writing the story.

I'm interested in where the PRA argument is going, as I've encountered that a lot since Chisum in the Tenth. Patridge had an attorney, and the court sanctioned the attorney. Chisum had a public defender, but there was no sanction. More division being created.

It appears there's still no unified position on the PRA. Interesting argument.

Why would the media care about the PRA? The news to be reported is that an ex IRS employee was sentenced to 48 months in prison. Her arguments are irrelevant to the fact of the prison sentence, no?

Certainly, but I'm sure we'll be hearing more about the case, as it's likely to go on appeal. My interest is in debunking tax protester arguments, and I get a lot of talk about the PRA.

It would seem to me if media were present, they'd have been at least moderately interested in what a former IRS agent had to say at her sentencing hearing. Maybe I'm wrong.

Former IRS Employee Convicted of Tax Crimes
WASHINGTON - The U.S. Court of Appeals for the Eleventh Circuit affirmed a four year prison sentence for tax defier crimes committed by Sherry Peel Jackson, a former Internal Revenue Service (IRS) employee and tax preparer, the Justice Department announced today.

In October 2007, a jury found Jackson of Stone Mountain, Ga., guilty on four counts of failure to file income tax returns. Jackson was sentenced, on Feb. 14, 2008, by U.S. District Judge Orinda D. Evans to four consecutive prison terms of 12 months each.

According to the charging document and evidence at trial, beginning in 2000, Jackson willfully and intentionally did not file her own individual tax returns. At that time, she also operated a tax preparation business and continued to prepare, submit and file individual tax returns for her customers. For the next three years, Jackson intentionally did not file her tax returns, despite an income of more than $400,000 in that time period. According to testimony at trial, Jackson said she did not file the returns because she did not know what the term "individual" meant in tax laws. The evidence at trial showed that Jackson in fact knew her legal duty to file with the IRS and intentionally chose to disregard the law.

Jackson raised several common tax defier arguments in her appeal, such as challenges to the jurisdiction of the court and a claim that the IRS Form 1040 did not comply with the Paperwork Reduction Act. All of Jackson’s arguments on appeal were rejected.

In May 2008, a federal court in Florida found Jackson to have been advancing frivolous tax arguments at a Pinnacle Quest International (PQI) sales conference and in PQI promotional materials. The court barred PQI and its principals from publicizing tax fraud schemes.

"This clear affirmation of such a strong sentence should be a sign to tax defiers across the country that frivolous arguments and bogus schemes do not work and can land them in prison for years," said Nathan J. Hochman, Assistant Attorney General of the Justice Department’s Tax Division. "Under the National Tax Defier Initiative, the Tax Division continues to vigorously enforce federal tax laws against tax defier conduct throughout the nation."

Assistant Attorney General Hochman thanked the Justice Department attorneys who represented the federal government in the criminal case against Jackson and the IRS-Criminal Investigation agents who assisted them. Tax Division attorney Joseph Giannullo and Assistant U.S. Attorney Richard M. Langway handled the case in the federal district court. Assistant U.S. Attorney Langway also represented the government in the Court of Appeals.

Hello Friends and Family,

I just wanted to give you an update on us. I know it’s been a while. I went to see Sherry last weekend without the kids and it was wonderful.

She is trying to keep her head up but, it gets pretty difficult at times. She calls her current environment “Romper Room Hell”. She has not been used to such behavior by adults and it sometimes annoys her tremendously. However, she tries her best to find a place where she can be alone to pray and listen to, or watch preaching and gospel teachings. She has found a couple of radio stations that she loves. Some of them have excellent Bible teachers and scholars. A few stations have some of her favorite jazz music. She also appreciates the books and magazines that some of you have sent for her to read. I feel like they keep her in the loop, as well as vicariously provide a way of escape from her physical environment.

She’s still working in the Chaplain’s office and is teaching finance classes. The Chaplain is leaning on her more and more. She’s become her favorite. It keeps her busy and it gives her access to tapes and DVD’s that she likes.

Our son, “Little Colin”, is in his second semester of his freshman year at Morehouse. He really likes it and is doing pretty well. He’s learning to be more responsible and is turning into a man. It does my heart good to see him mature. His majors are International Studies and Journal. I don’t know if he wants to do a double major or minor in one of them.

Our daughter, Rayna, is a junior in high school and is playing AAU basketball. She plays point guard and is a very good ball handler as well as a good shooter. She’s making good grades and I’m proud of her.

I’m doing well. I’m still a firefighter for the City of Atlanta and I’m still working my online business. It provides tremendous savings for those who shop online. Dear Congressman Johnson

I am Sherry Peel Jackson, your former CPA. I am writing you because I am concerned about my health and my life. Prior to becoming a political prisoner I was the picture of health. In late June, 2009 I started experiencing a rapid heart beat on an irregular basis.

Since this had happened infrequently in the past I did not think much of it. However, in Mid July it started happening on a regular basis and I became concerned. I went to the medical staff twice in Mid July only to be given a one-minute EKG test and powerful meds without proper diagnosis. I did not take them because I had not been seen by a specialist. One week later, on July 21 at 12:45am I left the dorm in flip flops to go tell the officers that I was having a heart attack. The officers on duty called the ambulance and the ambulance checked my heart on their portable EKG machine. It was beating at 150 beats per minute. They took me to Leesberg (spelling) hospital where I remained until Friday, July 24th at 11:30pm. During the hospital stay it was determined that my heart was healthy but my thyroid was producing too much hormone, thus speeding up my heart.

This is called hyperthyroidism or Graves disease. I was given two medications by the hospital – Methimazole, which is an anti-thyroid agent used to reduce the amount of thyroid hormone produced by the body and Metoprolol, which is a beta blocker used to slow the heart.

The hospital doctor told me that in four weeks (approximately August 21) the prison medical unit was to do blood tests to determine how the thyroid medication was affecting my body.

The blood test was taken in late August and I was told that I would be placed on the appointment schedule to come over and review the results. I was never called. I went over in early September and inquired of Dr. DeLeon as to how to get blood test results. He told me to put in a request to staff, so I did that on September 15th. It simply asked to see the results of the tests.

Sometime after September 23rd I received a response in writing, from Ms. Marich, that stated that I could either make a sick call (come over early in the morning wait in line and fill out forms) or come to Open House to see the results. Open house is held only on Thursdays from 3:00pm to 3:30pm. I went to Open House Thursday September 30th and was told by Ms. Marich that she could not find the results! I watched her look through and around several piles of folders in her office but at no time did she look on a computer for them. She told me to check back later. On Wednesday October 28th I passed out around 4pm and was taken to medical and cleared.

On Friday October 30th my lips started turning black as if I had been a lifelong smoker. By Sunday November 1st my lips were fully black.

My boss, the Chaplain, called medical and a male nurse was sent over from the medium security men’s prison on this complex (there are two maximum security, one medium security and one low security men’s prisons on this complex with the women’s camp). He took my blood pressure and oxygen and said there was nothing else he could do. He told me to go to sick call Monday morning, which I did.

I showed Mr. Coucho my lips and told him that something was wrong with my blood, I could tell. (I am leaving out gross details here).

He said I would be put on the schedule. However, the very next day, Tuesday morning, November 3rd, I found blood in my stool and rushed over to medical because I am smart enough to know that this is a major problem. I was chewed out for coming over to medical without a staff member telling me to come. I told Charlie, the female nurse and Mr. Coucho the PA that I was in the hospital in July, never got the blood work results and something was terribly wrong.

I am 46 years old and I know my body! I finally convinced them that I was not playing and was not stupid, so they ‘treated’ me with a packet for a stool sample test. Mr. Coucho looked on the computer for the blood test results from August and found them there!

The blood test showed a problem with the thyroid way back then!

He said I would be put on the schedule for new blood work later that week because these results were too old. He had a short conversation with Dr. DeLeon in Spanish and then said the thyroid count was off.

This was November 3rd. I administered the stool tests and returned them to Nurse Charlie on Friday November 6th.

Today is November 26th, Thanksgiving. I have not received the results of the stool test. I have not been given any new blood test.

My neck is swelling up like a blow fish and I am having trouble talking. I have been feeling very ill for the last two weeks.
Congressman, I don’t want them to kill me in here. As you well know, I am being punished for exposing government fraud. However, millions of people don’t file tax returns and I was just used as an example by the DOJ for their new program called the Tax Defiers Initiative.

I have a wonderful husband and two beautiful children. I have already spent 21 months in prison for a non crime, and I refuse to come out dead or maimed for life. I have not caused these people any problems. This is no threat but just for your information.
I also wrote the warden today. Things can’t go on this way as I languish in here for someone’s political gain. God doesn’t like ugly and He is the ultimate judge and vindicator.

I am really disappointed with the prison authorities at Coleman Federal Prison.
Usually when the authorities want to murder one of the inmates, that person is dead within 24 hours. Coleman is getting downright sloppy.
