Hi

On Friday, April 13th (the last possible day that it could be done to
include the year 2000) the government filed criminal charges against me.
The charge is from Section 7203 and it is willful failure to file. There
are four counts – 2000, 2001, 2002 and 2003.

This was not in Indictment, it was an Information. I have been told that an
Indictment is for felonies and an Information is for misdemeanors. Because

they filed the charges they finally had to unseal the affidavit of probable cause that the agent swore to the judge to get permission to invade my home.
This affidavit is just a listing of all of the places that I have spoken out
and asked the government to show the law. It does not state any criminal
acts on my part, but it does state that they had my family under
surveillance, they went through our garbage and they retrieved our mail.
They also went to my church and demanded the records of all my tithes and
offerings for those four years. Who is the criminal?

Anyway, the affidavit claims conspiracy, and three other “violations”.
However, after all was said and done they came up with willful failure to
file. Those of you that know the law know that we have an excellent chance
to win this case. Without getting into any details of our strategy, I have
retained Larry Becraft (that handled Vernie Kuglin’s case) and a local
attorney to help me. We will work to obtain the same outcome as Vernie.

I will need help paying legal fees. I have already taken out a signature
loan, but I have no equity in my home and can’t refinance for any funds. If
you would like to help us obtain a victory it would be kind of you to donate
towards a victory. I am working to get all of my “Breaking The Invisible
Shackles” DVD’s back, (they stole about 800 of them) and those that send at
least $100 will receive an autographed one if and when I get them back.

30088. I do not have a legal defense fund set up but hopefully you trust
that these funds will go straight to pay the attorneys (which they want to

the attorney fees and the known expenses like travel and hotel.

I will still continue to run my business and use those funds to pay my house
hold expenses, so please pray that clients won’t run from me now because of
these charges.

I pray that you are with me at least in prayer that we prevail and that our
country gets back to the country that it was meant to be. I think a victory
is needed and will help.

Earlier this week, Jackson (remarkably, through counsel) filed a motion to dismiss on the grounds that no law requires her to file a return. Now, the "argument" is dressed up in fancy language and expressed at length, along the lines of how it is supposedly only through the use of "interpretive regulations" that the duty to file arises, etc.

A pig in a tuxedo is still a pig, and perhaps a sanctionable pig.

On the same date (June 11), she filed a motion to dismiss on the grounds that the prosecution is in "bad faith", also through counsel. In effect, she argues that she is being prosecuted due to her associations and speech (does that mean she really did file?). In support, she cites real First Amendment - civil rights cases, such as Dombroski v. Pfister, 380 U.S. 479 (1965), NAACP v. Button, 371 U.S. 415 (1962), and Walker v. City of Birmingham, 388 U.S. 307 (1967).

The parties in those cases - who understood the meaning of sacrifice for vital principle - have been reported spinning in their graves.

FORMER IRS EMPLOYEE FOUND GUILTY BY JURY FOR FAILURE TO FILE INCOME TAX RETURNS

FRIDAY, NOVEMBER 2, 2007

ATLANTA. -- Sherry Jackson, 45, of Stone Mountain, Georgia, was found guilty on October 31, 2007 on multiple charges relating to her failure to file income tax returns in violation of federal law.

The case was jointly prosecuted by the Tax Division and the United States Attorney's Office in the Northern District of Georgia. In response to the quick jury verdict, U.S. Attorney David Nahmias said, "The jury took less than 25 minutes to find this former Internal Revenue Service (IRS) agent guilty. This case is a reminder that all of us, even those who used to work with the IRS and know the rules well, have to submit our tax returns and pay the taxes due."

According to the evidence at trial: commencing in 2000, Jackson, a former Revenue Agent with the IRS, willfully and intentionally did not file her own individual tax returns. During that same time period, however, she operated a tax return preparation business and continued to prepare, submit and file individual tax returns for her clients. For the next three years, JACKSON intentionally did not file her tax returns, despite an income of over $400,000 in that time period.

According to testimony at trial, Jackson said she did not file the her individual returns because she did not know what the term "individual" meant in tax law. The evidence showed that Jackson in fact knew her legal duty to file with the IRS, and intentionally chose to disregard the law.

Sentencing for Jackson is expected to be in January 2008 before United States District Judge Orinda Evans, although an exact date has not yet been set by the court.

This case was investigated by IRS-Criminal Investigation, and prosecuted by Tax Division attorney Joseph Giannullo, and AUSA Richard M. Lanway.

Yes, but in an area where you can buy a 6,000 sq. ft. house on a waterfront lot for $500,000, you can live pretty well on $133,000 a year.

EDIT: I rechecked property values and I was a little off for Stone Mountain. However, you can get a 3,000 sq. ft. home in Stone Mountain for $300,000 to $400,000.

Exactly. I would be willing to wager that 9/10 of the people we eviscerate here on this site do not really believe the garbage that they peddle. They got into scamming because of the incredible money they can make for the minute investment required to get their message out via the Internet.

I think this is the real reason that Joe Banister left the IRS because he could see, from his investigations, how much money was actually being brought in by disreputable accountants, lawyers and tax preparers who were using the system to generate phony or overinflated refunds; the fact that very few of these people were being prosecuted only made going over to the dark side even more appealing.

What's interesting about Jackson is that (at least regarding legal actions to date) she wasn't feeding the KoolAid to any of HER clients.

If she had been, I would have expected a DoJ injunction action much sooner than the criminal case.

However, I suspect that every return she prepared (assuming she followed the law and signed them as a paid preparer) will be undergoing some scrutiny.
