John James MacLean

A man who said the police didn’t have permission to use his name and claimed the attorney general didn’t give the Crown standing in his case will be back in court this week.

John James MacLean, 56, appeared before Chief Judge Nancy Orr in provincial court in Charlottetown recently to face three charges.

MacLean is charged with a probation breach, driving while disqualified and breaching an undertaking.

During his brief court appearance, MacLean, who was in custody and represented himself, said he didn’t think the attorney general gave the Crown permission to proceed with the case.

“It’s a fraud on the court here,” MacLean said.

Monday’s appearance wasn’t the first time MacLean was before the courts; in 2014 he was described as being a Freeman on the Land.

People who follow the Freeman on the Land philosophy believe they can opt out of being governed by laws if they don’t give consent.

It’s a stance Orr disagreed with when she refused to dismiss the case after MacLean said he wasn’t willing to enter a plea.

MacLean repeatedly said the Crown had no standing in the case, to which Orr responded by saying he was incorrect.

That led to a warning from MacLean.

“You move along at your own peril, then, your honour,” he said.

MacLean tried to argue the charges weren’t valid because the police didn’t have permission to use his name, including on the document that listed details about those charges, which is known as an information.

The information filed started the process, which was fraudulent, MacLean said.

“I’m trying to help you out here, your honour.”

MacLean refused to enter any please because he said doing so would give the provincial court jurisdiction over the matter, which he didn’t believe it had.

After the case was adjourned, MacLean was back in court the next morning before a justice of the peace for a show cause hearing to determine if he should be held in custody.

During that hearing he consented to stay in custody, despite his assertions the day before that he needed to get out so he could get documents from home.

MacLean will be back in court June 6 to enter pleas.

It sounds like they are going to have fun with this one, and that it isn't going to go well for him, particularly since he is still in jail for his cleverness. I do think he will find they DO NOT need his permission to use his name though.
The fact that you sincerely and wholeheartedly believe that the “Law of Gravity” is unconstitutional and a violation of your sovereign rights, does not absolve you of adherence to it.

John James MacLean gets sentence of 27 days in jail despite denying his own name, interrupting continually


CHARLOTEETOWN, PE - A 56-year-old man who refused to enter a plea in provincial court was found guilty Wednesday of three charges against him and sentenced to serve 27 days in jail.

John James MacLean, who also refused to acknowledge that is his full name, appeared before Chief Judge Nancy Orr in Charlottetown for a trial after she entered a not-guilty plea on his behalf.

MacLean was charged with driving while prohibited, breaching his probation and failing to attend court.


Orr found him guilty on all three charges.

MacLean, who the Crown previously described as following the Freeman on the Land philosophy, was disruptive throughout the trial making frequent objections that were all overruled.

The court heard testimony from MacLean’s probation officer who said he didn’t report after he was served with a probation order in September 2015.

In August 2015, MacLean was banned from driving for 18 months, and during the trial an RCMP officer who arrested him for driving while prohibited also testified.

She said MacLean didn’t give him a driver’s licence, insurance or registration when she asked for them.

MacLean objected in court to her testimony.

“No such thing as a driver’s licence,” he said.

Throughout the proceedings MacLean repeatedly interrupted Crown witnesses during their testimony, at one point saying Orr needed to do a better job of representing him.

“You’re doing a poor job of it,” he said.

MacLean said Orr was representing him and practicing from the bench because she entered the not-guilty plea on his behalf.

Orr said she wasn’t representing him and she entered the plea because he refused to.

After more outbursts, MacLean challenged Orr to find him in contempt to get out of what he called “kangaroo foolishness.”

MacLean also said he didn’t refuse to enter a plea.

“I just don’t want a contract,” he said.

The court heard MacLean has a criminal record and more than $8,500 in fines and restitution owing.

He said the fines and record belong to John James MacLean, who he claimed wasn’t him.

Orr said she was satisfied the record belonged to the person in court before her.

MacLean has been in custody since May 14 and Orr sentenced him to a total of 85 days in jail, leaving him 27 days after credit for time served.

Orr banned him from driving for a further 18 months and ordered him to pay $300 in victim surcharges.

This judge must not have had any dealings with FMOTL before. What makes her think that MacLean will pay the restitution or obey the order prohibiting driving.

We all have our delusions, I guess, even judges. She'll quickly be disabused of them.

This how Dean Clifford got started and later developed his mile long rap sheet. The difference being the guy doesn't seem to be going on the web to declare the he won and ask for memberships.

The cops know who this guy is and some saturday night they'll find him with a busted tail light and the whole routine will be repeated. My guess is that eventually the court will lose patience he'll get jail time. It might be that John loses it first, assaults a cop during a stop and gets time for it.

The guy who gets ticketed and/or arrested multiple times yet never ends up shoving or punching a cop is Brian Alexander.
