Alain Painchaud: Sovereign Energy Recycler and Speed Bumper

Post by Hilfskreuzer Möwe »

In Quebec, everything is a little different. That extends to the Wonderful World of OPCA Litigants. Here’s a recent newspaper report (http://www.lapresse.ca/le-soleil/actual ... ejette.php) about a chap named Alain Painchaud, whose perspective on life is aligned with a Sovereign/Freeman position – and it’s a fair comparison.

Unfortunately, this report will be somewhat vague, as I represent yet another failure of the Canadian education system and am sadly unilingual. I have therefore resorted to Google Translate to better understand Alain and his adventures (there appear to be many!) but that resource, too, has choked on some of this material. So take everything with that proverbial grain of salt.

The news report explains that Alain has ordered the arrest and trial of … well, pretty much the entire government apparatus:
(Quebec) Alain Painchaud is separated from Canada. His residence at 2775 Street near the CHUL Sasseville, is located in a year in a new sovereign republic. Engineer 45 rejects the authority of governments and courts. Except as himself accused ...

Well known in the United States and in Western Canada, the phenomenon of Freemen-on-the-Land or "sovereign beings" now has its representative in Quebec.

Saying persecuted and humiliated by the authorities, the electrical engineer Alain Painchaud wrote his declaration of sovereignty April 15, 2013, creating a new republic in Sainte-Foy area, with its own government, "People's Court" and any currency.

He warned the federal and provincial governments to denounce their illegitimacy and lack of valid constitution, he ceased to pay any form of taxes and fees.

He also argued that Canadian laws do not apply to him.

Alain Painchaud has nevertheless been a search of the Canada Border Services Agency in the summer of 2013 because he had imported a few hundred tablets tadalafil (sold under the name Cialis) and finasteride (marketed as name Propecia), two drugs that can be purchased directly by individuals. Alain Painchaud affirms the importance his own drugs duly prescribed because he no longer trusts the health system.

During the search, officers allegedly found two cell electric pulse (stunt-gun) and two legal weapons improperly stored.

Alain Painchaud was never presented to the court to meet the fifteen charges against him. He left Canada at the end of the summer to go to Thailand cure cancer through medicinal plants.

He was arrested upon his return Saturday at the Jean-Lesage Airport. Angry, Painchaud has been mastered by six agents.

Judges to imprison

The sovereign citizen wants to settle accounts with the authorities.

Whoever said Associate Chief Justice of the Court of the people of his sovereign republic has demanded the Canadian government to complete in February and issued warrants of arrest against all judges of the country ... including Christian J. Boulet, charged yesterday to hear his investigation under release.

The sovereign citizen also applies to all members of the Cabinet of Stephen Harper, senior government officials, governors general of Canada without forgetting all the members of the Government of Québec since 2003.

The offenses? High treason, fraud, "insulting the nation", robbery, extortion, terrorist financing.

All these judges and public officials should be arrested and jailed pending trial, ordered the chief investigator.

All the assets of judges must be captured and "stored in secret places, well kept," he said.

Even if they disagree with the ideas of Painchaud, which he described as "wacky", the Christian Boulet judge agreed to release him for the duration of the proceedings.

The sovereign citizen saw his passport confiscated and is committed to an amount of $ 100,000 without deposit.
As you see, no half measures from Alain!

Sticking his name into CanLII turned up a ton of cases. Unfortunately, many are brief and cryptic, however I eventually knit together a narrative. What I believe is the first of the saga is this one:
[There is an earlier sentencing decision which involves an Alain Painchaud (R. c. Painchaud, 2000 CanLII 7880 (QC CQ): http://canlii.ca/t/1fd43) who committed a truly horrifying sexual offence scenario – I am quite certain this is not our man given the duration of the sentence overlaps with events that belong in King Alain’s narrative.]

In this decision, King Alain and his company, Xian Electrical Systems Inc., are sued over a breach of contract. Allegedly they had developed “a revolutionary product that may allow the production association and the energy at a lower cost accumulation.” (para. 3). The decision does not explain if King Alain has developed a superconductor, a perpetual motion machine, or something more mundane. A later Court of Appeal decision explains the plaintiffs had invested money with Alain, and wanted it back, presumably when he didn’t deliver the goods.

King Alain had lawyers but they got out. In an early step in the litigation King Alain made a September 20, 2010 application to toss out the lawsuit and continue with a counterclaim, a modest $27,000 for his trouble and inconvenience: paras. 10-11. Then things escalate:
  • Sept. 27, 2010: an amended statement of defence and counterclaim for $1.7 million (para. 13)

    Oct. 5, 2010: another amended statement of defence and counterclaim which adds the Attorney General of Quebec as a defendant and ups the damages to $2.4 million in both a civil and criminal context (paras. 17-18)

    Oct. 13, 2010: yet another amended statement of defence and counterclaim – we’re not told the details of this one (para. 19)

    Nov. 8, 2010: guess what!? Another statement of defence and counterclaim! Now for $4 million (para. 28), this document includes a quite extraordinary list of objections (para. 27). Google Translate offers the following interpretation:
    • - break-ins and assaults on his person;
      - abusive investigation by the SQ;
      - wiretapping and seizure of his hard drive;
      - unrequited love from a police SQ;
      - was upset to have fun;
      - problematic relationships with madams and capable tivieux who train at the same sports club as;
      - problems with the hospital with a particular doctor;
      - victim of a judicial surgery;
      - conspiracy against him;
      - problem testicle;
      - claim for treatment outside of Quebec, at the expense of the Attorney General of Quebec;
      - abusive tax audits;
      - acts depriving the project of his life.
See? That’s what I mean. Quebec is different. Our OPCA litigants just never would claim “judicial surgery”, “unrequited love” from a police officer (Sûreté du Québec) (but whose love is it that is unrequited?! King Alain or the officer?), and certainly not “problem testicle”.

Long and short, King Alain’s counterclaim gets tossed, and he is declared a vexatious litigant. King Alain repeatedly challenges that result – no dice:
  • No. Usinage MD (2006) c. Painchaud, 2011 QCCS 892: http://canlii.ca/t/2g0fg

    No, we don't want to hear your new evidence. Painchaud c. Usinage MD (2006) inc., 2011 QCCA 316: http://canlii.ca/t/2fstz

    No, we're not going to reconsider. Painchaud c. Usinage MD (2006) inc., 2011 QCCA 384: http://canlii.ca/t/2g08k

    No no no!!! Painchaud c. Usinage MD (2006) inc., 2011 QCCA 656: http://canlii.ca/t/fkz29

    La la la we're not listening! Alain Painchaud c. Usinage M.D, 2011 CanLII 65638: leave to the Supreme Court of Canada denied
With those preliminaries complete we now get to the trial proper. It turns out Alain had developed and patented an apparatus to capture and recycle energy from vehicles as they brake. The plaintiffs made parts for the prototype, and when they learned the purpose of that they decided to invest and collaborate.

King Alain was about to demonstrate the apparatus to various government agencies. However, the plaintiffs were no longer able to provide free support, and so at a meeting (apparently over poutine no less!) the investments ceased.

King Alain returned with a technology to replace speed bumps in parking lots (!??!), but again, the plaintiffs weren’t interested.

The government was, but wanted a demonstration. However, the prototypes of neither the energy capture apparatus nor the super speed bumps were ready. King Alain was denied government funding. Xian Electrical goes bankrupt.

The plaintiffs' lawsuit was that King Alain lied about the technology when he said it was ready to commercialize.

First, a residual $90,000 counterclaim for trouble, inconvenience and legal fees gets tossed: Usinage MD (2006) inc. c. Painchaud, 2011 QCCS 5936: http://canlii.ca/t/fns06

We know the drill - King Alain now appeals that result on multiple grounds, all unsuccessful:
  • No. Painchaud c. Usinage MD (2006) inc., 2012 QCCA 50: http://canlii.ca/t/fpnvl

    No, we already told you once. Painchaud c. Usinage MD (2006) inc., 2012 QCCA 169: http://canlii.ca/t/fpt6r

    That's not new evidence that we care about! Painchaud c. Usinage MD (2006) inc., 2012 QCCA 292: http://canlii.ca/t/fq3fj

    La la la la still not listening!!! Alain Painchaud c. Usinage M.D. (2006) Inc. et autres, 2012 CanLII 49982: leave to the Supreme Court of Canada denied
After all that, Alain contests whether he should have to pay $2,502.87 in legal costs. He does: Usinage MD (2006) inc. c. Painchaud, 2013 QCCQ 3369: http://canlii.ca/t/fx4df

Alain demands the court reconsider that award. Answer?
So, you’re now sitting there, waiting … will the plaintiff investors get their money back? Dunno. Over four years later, the actual trial itself still does not yet seem to have occurred.

There’s one more bit of reported litigation:
King Alain made a complain in the Human Rights Court of Quebec – which contrary to its name is not a court, but just a human rights tribunal all dressed up. Alain is trying to appeal some of his litigation surveyed above. The “court” nicely explains he is in the wrong place, but thanks for trying.

So that’s it. My bet is a future search in CanLII will reveal yet more appeals. And more appeals. And more appeals…

I tried to learn more about King Alain, but only found his Facebook page: https://www.facebook.com/alain.painchaud.90

Sadly Google Translate won't touch that.

Enjoy...

So we have a triple header here, a frustrated legal scholar and as well as an inventor/genius, and wannabe sovereign nation since the big kids won't play by his rules, sounds sovrunish to me. Maybe he and Rasmus ought to get together and spout nonsense at each other, they sound like long lost siblings.

Now he just has to invent a magic ionic filter that imbues water with "healing energy".

At least the unrequited love was on the part of a policewoman rather than a policeman, assuming Mr. Painchaud is straight.

Perhaps it was unrequited due to Mr. Painchaud's testicle problem.

Judicial surgery has such a clinical sound to it. I prefer "ablation of a nut".

Mr. Painchaud's adventures continue:
Again, using Google translate it seems this news report is describing a pre-trial hearing for Alain's stun gun and drug smuggling charges. The trial is currently set for July, and expected to last 1-2 weeks.

Security was heavy. Alain also seems to have advanced argument and a counter-claim:
In its defense, which is dozens of pages, Alain Painchaud says "being harassed by the authorities." He asks "fair and equitable compensation" that evaluates to $ 50,000 to reflect its loss of revenue over the past four years. Alain Painchaud alleges income $ 200,000 per year.

Alain Painchaud is charged with importing several hundred tablets tadalafil (sold under the name Cialis) and finasteride (marketed as Propecia), two drugs that can be purchased directly by individuals.

In his defense, he claims to have a prescription from a practitioner who authorized him to order generic drugs in its name. Alain Painchaud pleads not trust the health care system since surgery.

The two arms of taser type Alain Painchaud claims to have purchased for $ 15 the two "toys used to scare."
It is unclear on what basis Mr. Painchaud believes he has a right to damages in a criminal action.

I'm sure we'll have more news in a couple months. LaPresse seems to be reporting this story quite closely.

I'll equally bet that the Revenue Canada or whatever it is called now will be thrilled with Painchaud's declaration of yearly income, and wonder if that is what he is actually paying against. I think that him publicly self accessing and declaring his income, which most likely is largely illicit will add to the entertainment value here?
