Perhaps because he knows the deadline for filing motions has already passed and it will be rejected on that basis alone, without the court having to get into the actual argument and rule on the merits. Easily dismissed nonsense is not a problem for the court; I would expect the judge to issue a verbal order to strike or a ruling to deny the "motion."

It may also be because he's got to let her direct her own defense and can't stop her from doing anything short of breaking a specific rule of the court. IANAL, so I'm obviously just speculating on this part.
Elbow counsel are made available to pro se defendants in an advisory capacity only.
I wonder if he advised against filing crap like this?

Heather's elbow counsel was advised by Judge Shirley to "assist her with federal court procedure and decorum." I would think he is obligated to follow a judge's instructions, and that he should disallow Heather's absurd filings on that basis.

A jury has been seated. 12 jurors + 2 alternates. The jurors are 9 females, 5 males. Varlan rejected Heather's latest filings.

The court rejects Heather's bullshit, she just turns around and files it again. The judge really needs to put a stop to this.

I suspect that that the "elbow counsel" made their comments known, if asked, and otherwise ignored it, since as has been pointed 1)out time has expired, and 2)as long as there name ISN'T on it they are out of the line of fire. She is literally a day late and a dollar short on that, and so will get to go in to court today, un-praecip-ed.

Her followers are clueless and haven't a hope of being otherwise. They see a new order coming in to being with HAT's revelations, reality sees her crashing and burning.

At what point does this rise to the level of contempt of court? Heather is barred from arguing jurisdiction issues, but that's exactly what these documents do.

ETA: Maybe this is standard for sovcit cases, and the court's just have to address it as it comes.

IANAL, but I suspect that the court's strategy, which we may see become a key tool in the anti-SovCit toolbox more broadly, is to just rule these motions as untimely and toss them out without having to read them or otherwise treat the contents with any validity.

If you read the court's rulings in the 2017 Florida case of pretend "Private Attorney General" Anthony Williams, he filed a ton of crap and the court basically had a paper form where they scribbled in the document number by hand and it merely said "after full consideration of the merits, defendant's motion is DENIED." Like a rubber stamp, basically. No cites, no argument, just "DENIED." We're almost to that point here.

I suspect judges have trial strategy just like the lawyers do. He already knows that Heather has some unusual beliefs. But he probably wants to try to keep things focused on what is at its core a relatively straightforward case with abundant evidence. He doesn't want to let the trial veer into anything where the jury could be confused or where he might be overruled on appeal. If she starts spouting nonsense on the stand, he could see the case overturned for not ordering a competency hearing. Or, worse yet, an acquittal.

He also would probably not want to get into the quagmire of an appeal based on a violation of her right to appear pro se if he slams her and makes her accept counsel.

So I suspect he'll keep letting her get away with this nonsense as long as there's an easy way to dispose of it quickly with rubber-stamp rulings as he did today. I am guessing he's probably saving the threat of contempt if she starts violating the order in limine and testifying about forbidden stuff or bringing it in when she's questioning witnesses.

According to BZ's update, not only did they pick the jury but they also had two witnesses testify, might be a quick trial hopefully.
