Prosecutors contend that David Russell Myrland -- apparently upset that his car was impounded following a traffic stop -- sent a threatening e-mail to Kirkland Mayor Joan McBride.

In the letter, Myrland, 52, of Redmond, suggested the mayor leave her home unlocked to facilitate a citizen's arrest, according to charging documents. He went on to claim to have issued a "writ of probable cause" and said he would be arriving at the mayor's home with 50 armed, concerned citizens, police said.
Four days after the e-mail, police contend Myrland left a short threatening message on the home phone of an assistant city attorney who'd been involved in a civil case filed by Myrland.

"Keep your doors unlocked," Myrland said, according to police. "Don't resist. You're going to be meeting people."

Myrland filed Chapter 13 bankruptcy back in 1996 (case no. 96-33796, U.S. Bankr. Ct., Western Dist. of Wash.) He is one of the clowns who has tried to argue that a taxpayer is somehow entitled to deduct the value of his labor from his income in calculating his federal income tax. The U.S. Bankruptcy Court shot him down on that one. In re Myrland, 209 B.R. 524 (Bankr. W.D. Wash., May 15, 1997).

I think I'll wait for the novel, ummm, transcript. I can't make out much of what he is "saying" over the background music.

I think the only things that protect him from a libel suit is that (1) he has no money and (2) the plaintiff Quatloosian, aside from having more pleasant things to do, like root canals, would have to prove that someone, somewhere, believed what he was saying.

On the other hand, depending on when this "war" occurred, he might be in violation of Federal hacking laws. Or perhaps impersonating a Federal Officer (FBI agent).

No, I suppose that would require that someone, somewhere, believed that he was arrested for child pornography, instead of for falsifying tax returns or other sovereign nonsense. (I am not a lawyer, but it saeems to me that if he invited discussion of his web site, that overrides any click-through contract preventing such discussion.)

I also find it amusing, even by sovereign standards, that a password could be considered an admission of an act. I found the 13-year-old discussion on sci.crypt as to whether one could legally refuse to give a password, if properly demanded by law enforcement, if it would be an admission of guilt to an unrelated crime. I believe the consensus was that the only way self-incrimination protection would work in the case of a file password, is that if government could not prove that the documents supposedly in the file actually existed; in other words, that the file was not random.

It goes beyond that. Not only is fair use built into the Copyright Act (see 17 U.S.C. 107), but various commentators give it First Amendment dimension (I don't have time to do the research right now). Myrland can put whatever he wants on his web site; so long as the quotation doesn't exceed fair use, there's nothing he can do.

How about trade secret protection? I realize that Myrland wouldn't have used the correct magic words, but I do get messages from my broker which state that the information is confidential and may not be discussed without his permission.

Yes, you have that agreement with your broker. The question is whether Myrland's attempt at a click-through EULA for nothing but text - writing - can be effective in the face of federal copyright law and the First Amendment. I don't think so, but it's not my field (although it is definitely an interest). I still don't have the time to research it. In addition, of course, is the issue of his damages. Zero, under any set of facts.

This has got to be the guy that put out those letters that pyramid schemers showed to their marks to 'prove' they were legal.
It's amazing how many scams use his 'legal opinions' in one way or another.
I recall that he was also used by promoters of TPCS (back in the '90s) to assure potential victims that "untaxing" was completely legal. Still, I never had him pegged as a sovereign, per se. He just seemed like a guy who could write up something legal-sounding to justify anything.

I primarily remember Myrland for when the State of Illinois took him on for the unlicensed practise of law, namely, advising people that gifting was legal, and won. Around 2001, I think - I would need to check my files to be certain.

Additionally, there's a Yahoo! Group frequented by Belinda Grandberry that has heavy Myrland ties... now what was it called again?

So his big revenge was spending at least three days making a fake website, which was quickly found to be fake and was ignored. It sounds as if the joke was on him.

Aside from being a tacit admission to serial lying, basically nothing went according to his 'evil scheme'. The only thing he had going for him was that no sane person would believe that anyone would go to that much trouble for such a pointless effort, and he blew that as soon as he opened his virtual mouth - and was ID'd.
