I'm of the opinion that Turner could very well deserve 167 years - lets think about what hes done here. Over the years, he has engaged in paper terrorism and taught scores of others on how to do the same. Thanks to him and his followers, he has slowed down speedy due process in numerous courts (which impacts the people actually seeking justice through legitimate means) and harassed/threatened numerous civil servants with fake liens. He has through his numerous sovereign citizen schemes, including RuSA, essentially taught people how to guarantee they never get real solutions to their legal problems. His teachings have lead to numerous people taking things like routine traffic tickets and ending up in jail or with huge fines (RuSA weekly calls are a testament to this). People who could have declared bankruptcy and started clean of their debts years ago have held out for the promise of billions of tons of gold coming any day now for 5+ years.

Turner has essentially destroyed peoples lives. And its true, many of them are so gullible that if it wasn't Turner and RuSA it would be some other scam. But his actions should have consequences when they impact the courts - thus stopping others from getting justice while the court has to deal with the paper terrorism - and harass court personnel.

I am not at all clear on Luis Ewing. The only one I can locate is in Seattle, where he is a chronic plaintiff but does not claim to be a lawyer. He may or not be the same Luis Ewing who posted an open letter to Wesley Snipes that he was going to have all his taxes redone and set him free.

Who is the one in San Diego - or is there a mountebank lawyer in San Diego of another name - and what craziness has he been in?

The San Diego individual may well be a pretend lawyer to go along with the pretend FRUSAoids, or may well just be another figment of their collective imaginations. Since no one has actually come forward to claim the honor, I am betting on figment. Too much in FRUSA world is in cloud cuckoo realm to spend too much time worrying about it.

Oh Jeez. He says he's a "tribal attorney". This is not to be confused with being a real lawyer nor with being able to represent someone in federal or state courts.

It appears that once Ewing conned a client (defendant in a criminal case) that the client would appear pro se, but that Ewing would secretly ghostwrite his pleadings, and this was desirable because, according to Ewing, the case of Argersinger v. Hamlin (1972) 407 US 25, 32 L.Ed.2d 530, 92 S.Ct 2006 said that he couldn't be jailed before the end of the trial if he said he was pro se. Argersinger does not say that; it says that a misdemeanor defendant is entitled to a court appointed lawyer, if financially qualified, if the charges have a plausible risk of incarceration (as distinct from a fine or public service). Ewing wanted to be paid an enormous amount - $1,300 - just to review a limited number of pages arising from the case, and would charge additional sums for more pages. His former client is a very unhappy camper in a very unhappy camp for the next several years.

I am amazed that Ewing has not been locked up for this. For Ewing, prison would mean confronting some of his dissatisfied customers.

Screwey Luis is a for real pretend attorney in the finest tradition. He and that other great legal mind PAM have a lot in common, starting with overweening egos, a lack of grounding in reality, and a similar win loss record, i.e. zip all.

I see the pretend president is still filing pretend legal documents, that are getting the treatment they undoubtedly deserve, the equivalent of the judicial roundfile.

Biggest expansion folder I ever used was good for just shy of a foot of paper documents. Poor clerk might have to go buy a second one!

At the rate Jimmy Tim generates BS documents they might want to splurge on a filing cabinet just to be safe.

Second one? They have to buy a new folder everytime a new motion or brief is filed.

It appears that Prexy Turner did fire his attorney! While there's nothing on the docket about the Jan. 24 court hearing on that issue, suddenly there are references to "standby defense counsel."

Also, the federal prosecutor, in a recently filed motion, said "the United States anticipates calling more than ten witnesses from out-of-state."

01/28/2013 57 ORDER as to James Timothy Turner: Status Conference set for 3/8/2013 02:00 PM in Courtroom 2FMJ before Honorable Judge Myron H. Thompson. The government is to arrange for the presence of defendant Turner at the status conference; standby defense counsel is to be present; and government counsel are to be present.. Signed by Honorable Judge Myron H. Thompson on 1/28/2013. (ag, ) (Entered: 01/28/2013)

01/28/2013 58 ORDER as to James Timothy Turner that the United States Magistrate Judge is to make appropriate arrangements for the subpoenaing of witnesses for defendant Turner. Signed by Honorable Judge Myron H. Thompson on 1/28/2013. (ag, ) (Entered: 01/28/2013)

01/28/2013 59 ORDER as to James Timothy Turner that, four business days before the jury-selection date, the government and defendant are each to file a brief (1) summarizing the evidence to be presented at trial; (2) setting forth the elements of the crime(s) charged and how the evidence does or does not satisfy those elements; and (3) addressing any evidentiary issues they think may arise at trial. Signed by Honorable Judge Myron H. Thompson on 1/28/2013. (ag, ) (Entered: 01/28/2013)

01/28/2013 60 MOTION Set Trial First on Trial Term by USA as to James Timothy Turner. (Gelfand, Justin) (Entered: 01/28/2013)

01/28/2013 Document RECEIVED as delivered by US Mail on 1/28/2013 to Clerk's Office from Donna Louise Streier (as POA for defendant) as to James Timothy Turner. Physically located in an expansion folder with case file. (ag, ) (Entered: 01/29/2013)

01/29/2013 61 ORDER granting 60 Motion to set trial first on trial term as to James Timothy Turner (1). Signed by Honorable Judge Myron H. Thompson on 1/29/2013. (ag, ) (Entered: 01/29/2013)

01/30/2013 62 ORDER as to James Timothy Turner: Status Conference set for 3/8/2013 10:00 AM in Courtroom 2FMJ before Honorable Judge Myron H. Thompson. Again, the government is to arrange for the presence of defendant Turner at the status conference; standby defense counsel is to be present; and government counsel are to be present. Signed by Honorable Judge Myron H. Thompson on 1/30/2013. (ag, ) (Entered: 01/30/2013)

01/30/2013 63 ORDER as to James Timothy Turner: Ex Parte Hearing (w/defendant and standby counsel) set for 2/4/2013 11:00 AM in Courtroom 5A before Honorable Judge Wallace Capel Jr. The U.S. Marshal is directed to produce Defendant for the hearing. The Clerk of the Court is directed to provide a court reporter for this proceeding. Signed by Honorable Judge Wallace Capel, Jr on 1/30/2013. (ag, ) (Entered: 01/30/2013)

It seems like this is headed toward something in Turner's favor if he's allowed to represent himself. His "defense" will be a sovcit farce that will prove better than the prosecution's case that he's a nut who wanted to avoid paying taxes while making money by showing others how to do the same.

I'm not a lawyer, but it seems such a charade that resulted in conviction would be overturned on appeal.

It means the federal government requested that the judge hold the trial for this case before he holds trials for other (unrelated) cases. It's for scheduling reasons. The judge granted the motion.

I uploaded the motion here:

The transcript from Prexy Tim's Oct. 1 arraignment and detention hearing was scheduled for release yesterday. I just tried to download it from pacer.gov, but was told I don't have access. Maybe it'll be available in a few days.

Here's the docket entry that says it would be available for public download yesterday:

11/05/2012 30 TRANSCRIPT of ARRAIGNMENT AND DETENTION HEARING (PDF ACCESS RESTRICTED FOR 90 DAYS.) held on October 1, 2012 before Judge Wallace Capel, Jr. as to James Timothy Turner. Court Reporter/Transcriber Patricia Starkie, Telephone number 334 262-1221. Transcript may be viewed at the court public terminal or purchased through the Court Reporter/Transcriber before the deadline for Release of Transcript Restriction. After that date it may be obtained through PACER. NOTICE OF INTENT TO REQUEST REDACTION DUE WITHIN 7 BUSINESS DAYS. Redaction Request due 11/26/2012. Redacted Transcript Deadline set for 12/6/2012. Release of Transcript Restriction set for 2/4/2013. (snc) (Entered: 11/05/2012)
