Bill Sizemore, the anti-tax activist who plans to run for governor in 2010, will face tax evasion charges stemming from his alleged failure to file returns.

Oregon Attorney General John Kroger said Monday that Bill and Cindy Sizemore didn’t file returns for the 2006, 2007 and 2008 tax years. A grand jury indicted the couple on three counts of Oregon Personal Income Tax Evasion.

The indictment was issued Oct. 27 but unsealed on Nov. 19, after the state’s tax amnesty period ended. Oregon Department of Revenue officials noted that the Sizemores didn’t take advantage of the amnesty, according to a release from Kroger’s office.

Sizemore filed paperwork to run for governor on Nov. 23. The filing came less than a month after two teacher unions sued Sizemore and fellow activist Loren Parks for racketeering. The case stemmed from charges that the pair set up a sham nonprofit to help cover up their political activities.

Kroger said an earlier civil suit provided evidence that the Sizemores had neglected their taxes. The Oregon Department of Justice’s Charitable Activities Section, which handled the earlier civil lawsuit for racketeering, referred the potential criminal charges to the Department of Justice’s Criminal Justice Division earlier this year.
