Without treatment EWE is going to live, what, 3-6 months? Neeloonie's description when translated into reality sounds like a normal attempt to do a psychiatric and medical assessment of EWE. The health authority will now have to decide whether to Section him on the basis of what happened in that attempted interview IMHO. They can't carry out an assessment with Neeloonie present and joining in either.

They can't carry out an assessment with Neeloonie present and joining in either.

For one thing she's not next of kin and for another there's no right to have a relative present at a Section 135/136 assessment.

That is true as far as the assessment is concerned because that is a strict professional interaction, in the same way that not even next of kin has the "right" to be present in the operating theatre during an operation.

However, for every other interaction, Ellis can give permission for anyone to be present. So unless he is sectioned (and I don't think even with the delusion so far displayed he has reached that legal threshold) he can give Neelu permission to be present during all his treatment plan meetings. That we think he is mentally ill does not come into it.

The bottom line is, in the UK if a patient does not want to be treated, they don't have to be and it would be illegal to do so even if it means a negative outcome.

That only applies where a person is legally capable of giving or withholding informed consent. I would say that Ellis is clearly not in that category. I would say he is sufficiently delusional that he doesn't understand the consequences of his refusal and he doesn't have the capacity to realise Neelu is insane and leading him down a very short path to destruction.

If the requirement for a section is that somebody is so mentally disturbed that they are a danger to themselves or others then he obviously qualifies.

If 'they' decide to section him and treat him for physical and mental illness to save his life until he is sufficiently competent to refuse dialysis I don't see any legal problem.

Perhaps I lack the empathy needed to work in medicine, but if I ran into this clownshow my response would be "You don't want treatment? Fine, you're going to die in a month. Now both of you get the fuck out of my examining room, there are other people who want and need my help."

I am of course talking about what our highly trained public health staff should do. My personal attitude would be pretty much the same as yours.

Note: a section 5(2) detainment does not have to be a mental health specialist. It is a temporary 72 hour hold, but the actual referral would be triggered immediately. As a lawyer :wink: , I'm sure EWE knows that.

I read that as Neelu saying that the "Blackmail Criminal Investigation" is one she filed in order to do advance the cause, expose the conspiracy and make her the hero of the story. I didn't watch the video, is that the Doctor speaking?

Indeed. Myself and Hucknall both commented on her post stressing that they postpone the nonsense for just one moment and take Ellis' health emergency with the seriousness that it deserves, but naturally she spouted a load of shite about fake test results and fake doctors and "he just needs to drink more water" and her neice's death etc etc before blocking me. The last thing I saw before the boot was her little acolytes suggesting that my mind was rotted from drinking too much flouride.

I had a morbid thought all this.

I wonder if Neelu got herself added to Ellis' will, or otherwise stands to benefit financially from his death.

I don't really think that - Neelu seems to have inherited several valuable London properties, and Ellis seems to be skint - but she's so eager to deny him medical treatment that it ought to be suspicious.
