30+ years ago, when I was an IRS Disclosure Specialist, we were briefly inundated with similar nonsense. At one point, we wrote a response; "Frankly, we don't know what you're talking about. Furthermore, we don't give a damn. Please go to hell, and don't bother us anymore." Our boss would not approve it, as we placed it on a template that gave the writer appeal rights.

Georges latest request to the ICO - "What is the definition of a record" has been reported for admin attention as vexatious or a request for personal information. As it doesn't meet the latter it must be the former.

George has a little bit of a point with that. The responses he's been getting haven't exactly said why they are refusing to answer his questions.

Now here's an example of a much better response someone else got about WeRe Bank. It explains why it is not treated as an FOI request; answers the posed questions one by one; calls WeRe Bank a fraud about as clearly as a government body can; and is oozing with contempt for the questioner and the subject matter.

I understand you’ve asked for this to be treated as a Freedom of Information (FOI) request, however as the information is publicly available on our website this is not being taken forward by our FOI team. This has been passed to the Customer Contact Centre, as we’re the most appropriate team to answer your questions.

For ease of clarity, I’ve addressed your questions in the order raised.

1. Is WeRe Bank committing fraud?

This isn’t something that we’re able to comment on. But we’d urge individuals to be very cautious when using WeRe Bank’s service as they don’t have protection from the [1]Financial Ombudsman Service or [2]Financial Services Compensation Scheme if things go wrong.

2. Is special presentation of a cheque a known banking process?

Yes, Cheque & Credit Clearing Company Limited has information about [3]special presentation of cheques on their website. They’re the organisation that operates the Cheque & Credit interbank payment system in England, Scotland and Wales. If you have any queries about this, you may wish to [4]contact them using the details provided on their website.

3. Are banks regulated on a voluntary basis?

No, firms carrying out the activity of accepting deposits will usually have to be regulated by us and comply with the rules set out in our Banking Conduct of Business sourcebook (BCOBS). Any firm found to be carrying out a regulated activity without the necessary authorisation may be committing an offence and be liable to a penalty.

Regulation of WeRe Bank

As you’re aware, we’ve issued a [5]statement about WeRe Bank. It seems that although they’re calling themselves a bank, they don’t appear to be carrying on any activities that would require them to be authorised by us. We’ve advised consumers to beware of using the ‘cheques’ issued by WeRe Bank, as these are not considered legal tender. A creditor is entitled to be paid in legal tender and can refuse payment in any other form, which may result in charges for late payment and other sanctions.

You have a point but I can see why organisations being bothered with this freeman crap don't bother going into details. For one thing they don't have to and for another (and I would say more important) reason these morons don't want to hear the answer in any detail and will just ignore any answer they get which doesn't confirm that they were right all along.

The answer to all of the 'birth bond' crap is quite simply "It doesn't exist" but anybody with more than a slack handful of brain cells would know that already. Telling a moron he's a moron doesn't really help because, being a moron, he's too stupid to understand it.

They don't have to go into details, they just have to give a legal justification under FOI law for not answering the question. "This agency has no records pertaining to this inquiry"; "We have already responded to your question about this topic on X date"; "This information is freely available online"; "You have sent X requests to this office in the past Y days and we consider this request vexatious." Those are all legal reasons under UK FOI law to refuse to answer.

But they do have to comply with FOI law. They can't answer his questions because they are from cloudcuckooland, but there are more skillful ways to deflect than "this is not an issue HM Treasury can help you with."

Here's what I would do:

Dear Mr Tsigarides

[Agency name here] has no records pertaining to an account of the type you describe. [Agency name] is not aware of the existence of any such accounts. All your questions about how these accounts function are therefore moot.

Any further FOI requests on this topic will be considered vexatious, and will receive no reply of any kind.

You have a perfectly valid point but, playing Satan's avocado for a minute all that reply is going to do is provoke another 'request' asking why they have no records and who does have the records. :shrug:

Which they can legally throw in the trash. If they send a proper refusal letter, they do not have to respond to subsequent FOI requests on the same topic. Among many other reasons they don't have to reply to his drivel.

Most FOI departments are dealing with lots of "difficult" requests all day long, every day of the week so they are well used (if not a little resigned) to answering garbage from time wasting tits.

They should operate a three pointless requests and you're OUT!

Brilliant stuff, it's great to see George hasn't been put off by his recent winning(losing) streak.

I'm a tad concerned that the poor sods on the other end are now reporting all his stupid questions though. If George gets barred, what the heck will we do for entertainment!

I know it is just so much feldercarb, but I really would like to know what the magical significance of being "a living breathing alive Man living on the land" as opposed to say "a living breathing alive Man not living on the land" or "living in the water" is and why they should have special rights and privileges none of hte rest of us do? I really would like to see that articulated and the significance of it explained by one of these doofuses doofusi???? I really am dying of curiosity. :sarcasmon:

Then he goes on to demand, very politely of course, that they respond on his time table not there, good touch, and the good old unilateral contract bit.

He has at least gotten around to admitting that it ISN'T "a request for legal or lawful advice" which means they shouldn't have to actually answer ANY of it. Good move George.

In one move he's nominated himself a vexious requestor. George is a true idiot's idiot.

There's a Bugs Bunny cartoon where Bugs takes on a vampire. He discovers that saying "abra cadabra" turns the vampire into a bat, and "hocus pocus" turns him back into a vampire. And, as you noted, they also employ other common FMOTL tactics. Though I must say, George raises the stakes by trying to foist a unilateral contract in less time than they are permitted by law to reply. He's not just an idiot's idiot, he's an asshole's asshole.
