- The Trustee assumes the truth of many things to which Bundy testified. In fact, he is a lying dirtbag.
- Even by his own words, Bundy has far more than he admits to now. For example, at the time of the filing of St. Luke's Idaho defamation suit, Bundy said that his net worth was $5-7M.
- Due to the work St. Luke's has done, collection of far more than the proposed settlement amount should be relatively easy, with the aid of court orders if necessary (as it obviously will be).
- Bundy has lied, delayed, concealed assets and outright disobeyed orders at every turn.
- Bundy should not get any sort of break as a reward for being obstreperous. In fact, that would only encourage others to do the same.
- St. Luke's is the only creditor, and they - not the Trustee - have done all the work, at considerable expense. Moreover, Bundy's pre-bankruptcy bullshit caused them considerable harm. $52M dollars' worth, to be exact.
- Did we mention that Bundy is a lying dirtbag?

Actually, showing my ignorance of all things bankruptcy - St. Luke's claims may not survive a Trustee-Bundy settlement. They vociferously oppose it. Among the bases for their opposition:

Yes, that was the problem I was having understanding why a settlement was being considered, given that section 523(a)(6) was ruled as being in play. It was obvious that Bundy went the trustee and offered to part with some hidden cash to rescue the listed physical assets in the bankruptcy estate. The trustee's mindset was equally obvius: since the debtor is offering me a fair amount of money to cover these assets, money that probably will not be able to be collected otherwise, it makes sense that we should settle. The problem is as you note, Wes, that Bundy had demonstrated to the court that he has tried hide assets and income, has used the bankruptcy as a dodge to rip off his creditor and that he is not entitled to a discharge or settlement.
Settlement is a dangerous word since the implication is that the goal is for the debtor to receive total relief from his/her creditors in return for an agreed and approved amount tendered to the creditors. The court would have to approve such an agreement and would have to give all creditors their chance to object. Bundy tried to end run this by the court and the trustee should have known better than to consider entering into this agreement given the issues noted above. As I have said before, trustees are not always on the ball when it comes down to them wanting to get another estate closed and off of their hands.
My wild guess is that an approved settlement would cancel Section 523(a)(6) since St. Luke's did not cite that in their response.

While we wait to see what happens next on the Ammon bankruptcy shenanigans front, a relative of Bundy's made a little news in the the House of Representatives. Celeste Maloy, niece to Cliven Bundy, has been mentioned earlier in the thread about her running for office. She has been elected and has recently submitted legislation for dispersal of BLM federal lands in Utah. I am not going to get into the politics of this issue; there are too many interests out there for either side of the coin that will be toeing the line over this bill.
However, the point I am making here is that, unlike her relatives, Maloy is taking a legal route to dispose of federal lands. She is not relying on tactics of intimidation, lies, distortion of history, squatting and inciting others to physcially oppose the government.
